Conditions of Entry

Offer Restrictions

Open only to Australian residents except directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter or of the agencies or companies or participating stores associated with this offer.

Offer Period

9am (AEDT) on 15/10/15 to 5pm (AEDT) on 31/01/16.

Claim Method

If a consumer has purchased a Garnier Pure Active 3 in 1 product (Eligible Purchase) during the Offer Period from any Garnier Active Pure 3 in 1 stockist in Australia (Store) and is not satisfied with the product after using if for at least 7 days, they can submit a money back claim for the product as follows:

  1. (a)visit www.garnier.com.au and follow the links to the Garnier Pure Active 3 in 1 online claim form;
  2. (b)fully complete and submit the online claim form, including by stating in 15 words or more why they were not satisfied with the product at the end of their 7 day challenge;
  3. (c)once the claim form has been submitted in accordance with paragraph (b), print off a copy of the claim form; and
  4. (d)send their printed claim form and original itemised receipt (Proof of Claim) in an envelope with their name and address on the reverse (which must match the details provided in their claim form) to: Pure Active Money Back Offer, Reply Paid 2095, PO Box 2095, Preston, Victoria 3072 to be received by the Promoter by last mail received on 13/02/16.

Each claimant will receive a return online notification confirming their online claim has been submitted and reminding them to send in their Proof of Claim. By entering this competition, claimants consent to receiving this electronic message.

If the Promoter does not receive a claim form submitted online followed by the relevant Proof of Claim in accordance with the Claim Method above, that claimant’s claim will be deemed invalid.

Refund Details

The first 1000 valid claims received by the Promoter in accordance with the Claim Method will receive a refund by cheque for the full purchase price as stated on their itemised receipt up to a maximum of $15 (inc GST). If a claimant’s Eligible Purchase receipt states a purchase price higher than $15 (inc GST), they will still only receive a refund of $15 (inc GST).

For the avoidance of doubt, the Promoter will consider the first 1000 claims based on the claims via the online form, provided that the online claim is validated with the relevant Proof of Claim as set out in the Claim Method.

Refund Pool

The total refund pool is valued at up to $15,000 (inc GST).

Claim Limits

Limit of 1 claim per person.

Receipt Requirements

Claimants must provide their original itemised receipt with their claim in accordance with the Claim Method section of these conditions.

Claimant Notification

Successful claimants will be notified in writing (online when they submit their claim) and should allow 30 days for delivery of their refund.

Refund Claim Date and Time

If a refund is returned undeliverable and despite the Promoter’s best efforts, is not accepted or claimed by 31/03/16 the relevant claim will be deemed invalid.

  1. Information regarding refunds and how to claim forms part of these conditions. By participating in this offer, claimants accept these conditions.
  2. The offer will be conducted during the Offer Period.
  3. Without limiting the Refund Details, Proof of Claims must be received by the Promoter by last mail received on 13/02/16. Claims are deemed to be received at the time they are received by the Promoter and not at the time of submission by the claimant. Failure of a claimant to provide their original itemised receipt (as per the Receipt Requirements) (without alteration) to the Promoter upon request may, at the Promoter’s discretion, result in an invalid claim (and, at the Promoter’s discretion, in all of the claimant’s claims being invalid).
  4. The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Claimants who claim using multiple email addresses or aliases may be disqualified. Automatically generated claims will not be accepted. Consumers are responsible for their own costs associated with accessing the Internet.
  5. The refunds are as stated in the Refund Details.
  6. Successful claimants will be notified in accordance with the Claimant Notification section of these terms and conditions.
  7. Successful claimants must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the receipt of any refund, free of charge, and they consent to the Promoter using their name and image in promotional material.
  8. The Promoter may require claimants to provide proof of identity and proof of residency at the nominated refund delivery address. Identification considered suitable for verification is at the Promoter’s discretion.
  9. If a claim is deemed not to comply with these conditions of entry, the claim will be discarded.
  10. The Promoter may, in its sole discretion, disqualify all claims from, and prohibit further participation in this offer by, any person (including without limitation a claimant) who tampers with or benefits from any tampering with the claim process or with the operation of the offer or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this offer, is contrary to law or is otherwise inappropriate.
  11. The Promoter’s decision is final and no correspondence will be entered into.
  12. Refunds are not transferable or exchangeable.
  13. If a refund is returned undeliverable or is not accepted or claimed in accordance with the Refund Claim Date and Time, the relevant claimant’s claim will be deemed invalid and the Promoter will award the refund to the next valid claim that did not receive a refund, subject to any written directions given by the NSW and SA gaming authorities.
  14. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury (including, without limitation, allergies, skin conditions or other reactions) or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this offer or accepting or using any refund, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
  15. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in transit to refunds. Delivery of refunds is within Australia only. Delivery will be made to the address provided by each successful claimant on their claim form and envelope. It is the responsibility of each claimant to ensure that the address details provided to the Promoter are correct.
  16. The Promoter may communicate or advertise this offer using Facebook. However, the offer is in no way sponsored, endorsed or administered by, or associated with, Facebook. Claimants are providing their information to the Promoter and not to Facebook. Each claimant completely releases Facebook from any and all liability.
  17. If for any reason any aspect of this offer is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the offer, or invalidate any affected claims, subject to any written directions given by the NSW and SA gaming authorities.
  18. The Promoter is not liable for any tax implications arising from refunds. Independent financial advice should be sought. Where this offer involves, for GST purposes, supplies being made for non-monetary consideration, claimants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
  19. All claims will be the property of the Promoter. The information claimants provide will be used by the Promoter for the purpose of conducting this offer. The Promoter may collect claimants’ personal information (including through its contractors or agents) or disclose claimants’ personal information to its contractors and agents to assist in conducting this offer or communicating with claimants including to overseas locations such as New Zealand, the USA, Canada, Singapore and other countries in Asia and the EU. By participating in this offer, claimants consent to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future competition and marketing purposes regarding its products, including contacting the claimant via electronic messaging. By participating in this offer, claimants consent to receiving SMS or email messages from the Promoter. The Promoter is bound by the Privacy Principles in the Privacy Act 1988. Claimants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address stated in the Promoter section of these conditions. The Promoter’s Privacy Policy, located at www.loreal.com.au/_en/_au/tools/privacy/privacy_1.aspx, contains information about:
    1. (a)how claimants can seek access to the personal information the Promoter holds about them and seek the correction of such information; and
    2. (b)how claimants can complain about a privacy breach and how the Promoter will deal with such a complaint.
